We advise the customer to read this document before proceeding with any order, payment or the use of our site and services.

This is a legal document drafted by Ytb Industries (Pty) Ltd, made between the customer also referred to as “you”, “your”, “client”, “their”, “persons” and Ytb Industries (Pty) Ltd also referred to as “we”, “our”, “us”. Please take the time to read through this document as we will not be held liable for any points discussed in this document that are not adhered to. These terms will apply to all our customers or anyone making use of our Site. Supplemental terms and conditions or documents that may be posted on our site from time to time are incorporated herein by reference. We reserve the right, in our sole discretion, to make changes or modifications to these terms and conditions at any time and for any reason. We will alert you about any changes by updating the “Last updated” date of these terms and conditions and supplemental documents mentioned above. It is the customer’s responsibility to periodically review these terms and conditions to stay informed of updates.

PRODUCTS:
We make every effort to display as accurately as possible the colours, features, specifications, and details of the products available on the Site. However, we do not guarantee that the colours, features, specifications, and details of the products will be accurate, complete, reliable, current, or free of other errors, and your electronic display may not accurately reflect the actual colours and details of the products and product images are only used for display purposes. Please note that all items are based on the availability of stock as we do not keep stock on hand. We can also discontinue an item listed at any given time without prior notice.  Please note that our pricing can increase at any given time without prior notice.

QUOTATION/ORDER/PAYMENT PROCESS:
We will always try to make the quotation and order process as convenient possible. – — You can place a quote/order online.
– Should you want to supply us with your own garment/s for printing you can send us an email.
No quotation/order can be placed and will be accepted on our WhatsApp business account number.

Quotation –
Invoices are only valid for 15 days from date of issue. Should you not pay the invoice in 15 days we will assume that the customer only wanted to receive a quotation on product services.

Orders –
All orders are processed once an order is placed and a 50% deposit is paid and reflect in our bank account. In the event where an item is out of stock, we will get into contact with the customer, offering an alternative product option or service if possible. If the customer is not satisfied with our options, we will then refund you for the amount paid on the product not in stock. Be sure to check your invoice thoroughly to ensure that we have invoiced for the correct item and quantity thereof. Also make sure that we are sending your order to the correct address if you have chosen delivery/shipping of your order. It is also the customer’s responsibility to provide us with the correct email address to make sure that you receive all emails sent from us regarding your order. Ytb Industries (Pty) Ltd cannot be held responsible for not reaching any deadline if there is a delay in the response from the customer in any way regarding the order placed. In the event where an invoice is approved, and payment has been made and the customer receives the incorrect products and or quantity, Ytb Industries (Pty) Ltd will not be held responsible to send new products at our own cost or to make an urgent deadline. Please make sure everything is as you want it to be on the invoice, we send you. We cannot ensure that a replacement can be sent by a certain deadline. An order is only confirmed once a 50% deposit has been paid and reflect in our business bank account. We cannot place your order into any design or production line-up without successfully receiving a 50% payment of the total invoice.

Exceeding 15-day period on invoice –
We do advise the customer to confirm the price/total of the invoice before making payment when you exceed the 15-day period on invoice from date of issue. This will ensure that the products ordered are still in stock and that the pricing did not change.

Order cancellation –
In the event where you as the customer decide to cancel your confirmed order and we haven’t started any designs or purchased any stock, there will be a R50.00 admin fee deduction from the invoiced/paid amount. In the event where we have started designs or purchased stock; you as the customer will then forfeit the deposit payment (50% of the total invoice).

Payment –
The preferred payment method is via EFT/Bank transfer only. Please refrain from making any direct cash deposits as we will then have to invoice for the bank fees on top of the direct cash deposit and it also makes it difficult to track payments as some banks do not allow for a name reference. Should you make an immediate payment, please make 100% sure that we receive the proof of payment. Some immediate bank payments use a numerical reference instead of the one you chose and then we will have to figure out who the payment comes from. We prefer that the customer always send us proof of payment to avoid such confusion. Please note that Ytb Industries (Pty) Ltd requires full payment, via EFT/Bank Transfer and it needs to reflect in our bank account before any order will be released from our premises. This also applies to all order collections and courier collections. This will not be negotiated, and no order will leave our premises without being paid in full. We reserve the right to correct any errors or mistakes in pricing, even if we have already requested or received payment.

Payments made into our account –
Do not make any payment before we have sent you a formal invoice. Please make sure to use your invoice number as reference when making a payment into our account. Please do not use your name/surname as reference. Should someone else pay on your behalf, make sure to provide them with your invoice number for reference, otherwise we will not know who to allocate the payment to and this will also delay the process of your order. Ytb Industries (Pty) Ltd will not be held accountable for any missed deadlines or extended lead times in the event where an incorrect reference was used. Please send your proof of payment to orders@ytbcompany.com

Bulk discount –
We do provide discount on bulk orders; it will be added to the customer’s invoice/quote if applicable. Please note that bulk discount is given at the sole discretion of Ytb Industries (Pty) Ltd and can be withheld at any given time by Ytb Industries (Pty) Ltd. Discount will not be given on any items on sale.
Discount applies when the following units per product is ordered:
10-39 units 10% discount
40-79 units 15% discount
80+ units 20% discount

PRODUCTION/DESIGN PROCESS:
We can assist in adding wording/text to images/designs provided by you. Should you require any logo, imagery or design made from scratch you can contact us, and we will discuss whether we will be able to assist in your requirements. Please note that with any logos, imagery or designs made from scratch additional fees will apply and a separate 5 to 15-day lead time will apply, for this is seen as a separate service.

Design lead time –
Design lead time is 2-5 working days, you will receive your layouts within 2-5 working days for approval. After the layout has been approved your order will be placed into the production line-up.

Layout –
Upon the receipt of your layouts which is sent via email only, you as the customer is responsible to ensure that all elements in the design is as you seek it to be. Please make sure everything is 100% to your needs. This means you as the customer should be aware of the following:
1. Spelling
If you as the customer approve a document with a spelling error, Ytb Industries (Pty) Ltd will not be held accountable to redo the order on our costs, standard fees will apply. We are human and anything can happen, that is why we send the customer a draft to approve. Please also ensure to check name spelling and grammar or punctuation marks. In the event where you as the customer did request a change but we have failed to correct the mistake, we are responsible for all costs to replace a product or will refund the customer in full.
2. Sending your own artwork/images
This will mainly apply to the customers who sends their own designs or the orders that consists of photographic elements. If you as the customer send us low quality images, pixelated images, or blurred images, we will not be held responsible for the low-quality artwork you will receive. Please refrain from sending us any WhatsApp images as this application reduces the original pixels. In some cases, you might get away with low quality photos, but we will not be held responsible for any such prints that does not meet your expectations afterwards. If you send us designs that are print ready and we just need to produce the products and the design is not up to standard and we do not notice it until after printed, Ytb Industries (Pty) Ltd will not be held accountable for any artwork not generated by us, this includes any discolouring as well. You need to make sure your screen is calibrated before sending us any print ready files. We recommend always sending images above 720 pixels and when sending us artwork from the browser, then look for the 1000 pixels and above.
3. Sublimation printing
Sublimation printing is a method used where permanent full colour printing is applied to various products that are specially treated and prepped for sublimation printing. We cannot print on any substrate as it either must be polyester based or specially coated for sublimation printing. Our sublimation printer does not print white and the “white” resembled in designs will then be the colour of the product base as all sublimation items/products we usually print on are mainly white, but sometimes metal. Please note that in some cases the colours might not print as pure as you see on the screen when receiving your layout. This is because the colours presented on screen is pure 100% whereas we cannot guarantee that the computer to printer reads the colours 100% the same way. We make use of CMYK ink, and the colours displayed on the screen are usually in RGB format. For example, neon colours when using sublimation might appear duller that usual. This does not usually vary much but there will be a slight difference between the screen colours and the printer colours, most of the times this is hardly noticeable. This will also come in to play when you print the same design on different products due to the product texture or surface. For example, if you print the same design on a mug, coaster, or garment. These are three different products with different printing processes, times, and heat. They will all print greatly but the colour might differ slightly depending on the design since they have all different surfaces. Please note that our sublimation printer and heat press only allow for a print size just under A4 and therefore we cannot print in large format.

Production lead time –
Production lead time is 3-10 working days.

Total order completion-
Please allow for 5-15 working days in total for your order to be completed. We always strive to complete an order as quickly as possible, but things do happen and unfortunately our printing equipment cannot run/function when we experience loadshedding. Please take note that lead time working days refer to Monday-Friday. Weekends and public holidays are excluded. Should there be any delay in processing your order we will notify you of such. A lot of our products are made on order, and we do source products from other suppliers and factories and therefore we need to take their lead times into account as well. The 15 working day lead time allows for some extra time in case of emergency as we are a small business, but we will always strive to complete your order before the advised lead time as mentioned above.

GARMENT INFORMATION AND SIZING:
We will provide garment sizing to the best of our ability and as given by our suppliers. Ytb Industries (Pty) Ltd will not be held accountable for any garment that does not fit properly. All the garments we order from our suppliers or that is provided by you have set measurements and we are therefore not able to make any sizing changes to the garments.

Supplying your own garments for printing –
Although not preferred, Ytb Industries (Pty) Ltd does allow the customer to provide their own garments, however the customer should know that we cannot always count on technology and therefore there is always a risk that something might go wrong, and we recommend the customer to supply us with extra garments. In the event where the customer supplies their own garment, please take note that Ytb Industries (Pty) Ltd will not be held accountable to replace stock supplied if the printing goes wrong, we will not charge the customer for the print that have gone wrong, but the replacement of the garment is on the customer’s own account and the customer should clearly understand that we cannot always control technology and the printing end-result. The customer should also be aware that when the customer supplies their own garments for print that Ytb Industries (Pty) Ltd cannot be held accountable if the fibres in the garments aren’t correctly balanced and then the print does not take properly even if it states that the material is 100% polyester or 70% polyester. For example, our sublimation printing can only occur onto 100% polyester and does not sublimate on anything without at least a 70% polyester blend, but we have experienced prints that did not take properly on garments provided by customers due to the fibres in the garments that aren’t correctly balanced, although the label stated that it is 100%/70% polyester. Please ensure to check in with us before spending lots of money on garments and then we cannot successfully print onto them. If you as the customer, then decides to still supply the garments then Ytb Industries (Pty) Ltd will not be held accountable for any production failures. Also take note that we cannot print in large format for our printer and heat press only allows for a print size just under A4.

REFUNDS AND RETURNS:
Due to the nature of our business and services offered, Ytb Industries (Pty) Ltd cannot exchange one product for another and therefore if the dissatisfaction of a product is caused by something we have caused; we will try and resolve the matter to the best of our ability. Ytb Industries (Pty) Ltd will try and replace the product as soon as it is possible, however in the event where we cannot meet the deadline, we will offer a full refund.

Complaint 48-hour time frame –
Please do note you as the customer have 48 hours after receipt of the order to lodge a complaint via email only regarding any item in your order. If you fail to lodge a complaint within the 48 hours (this includes weekends, public holidays, or company closure times) then you will forfeit the faulty product replacement and standard fees apply. Ytb Industries (Pty) Ltd will not replace any product (in the case where it is our mistake) after the 48-hour time frame.

Attempts to make changes to our products –
In the event where a customer attempts to make changes to our products without consulting us beforehand and then demands a new product or a refund, the customer will forfeit the refund/free replacement of the product, we will not replace any product that has been tampered with in any way without our knowledge. Any changes made to one of our products will not be refunded and the customer will void their replacement.

Proper proof –
Upon agreement between Ytb Industries (Pty) Ltd and the customer proper proof must be given by the customer via email only and Ytb Industries (Pty) Ltd may ask the customer to provide proper images of any products included in the order and all refunds or re-production of any products will be at the sole discretion of YTB Industries (Pty) Ltd.

Approved layout and invoice –
Please note: If an incorrect product or product size was delivered to the client (meaning the client approved the layouts/invoiced products) Ytb Industries (Pty) Ltd will not be held accountable to replace or refund the product. Ytb Industries (Pty) Ltd will assist the client to receive the correct products thereafter but standard rates and fees will apply.

Bank account info for refund –
It is the customer’s responsibility to provide Ytb Industries (Pty) Ltd with the correct bank account details for the customer to receive their refund. In the event where a customer provides any incorrect banking information and the refund has already been made by us, Ytb Industries (Pty) Ltd will not be held liable to make another payment to refund the customer and they will forfeit their refund.

SHIPPING/DELIVERY, COURIER SERVICES AND INSURANCE:
Ytb Industries (Pty) Ltd makes use of a few reliable courier companies that the customer can choose from. This will be for the customer’s account. The courier amount will be confirmed with you for approval.

Estimated shipping time frame –
The shipping time frame will be dependent on the shipping option chosen by the customer, but the estimated shipping time frame is 2-9 days. Please note that the shipping time frame will be in effect once your order has been placed for shipment/delivery by us. Ytb Industries (Pty) Ltd will not be held responsible for any delay on shipping caused by any courier providers.

Tracking info –
The customer will receive the needed tracking info once your order has been placed for shipment/delivery. Please do note that we will try and assist the customer to the best of our ability, but the customer is responsible to track and trace their own parcels.

Liability –
Once the parcels leave the premises of Ytb Industries (Pty) Ltd it no longer belongs to Ytb Industries (Pty) Ltd and therefore we cannot be held accountable or take any responsibility regarding the actions which the courier company decides to take. Please note that Ytb Industries (Pty) Ltd will provide the customer with all the needed information to successfully track and trace their parcel as well as the needed contact information so that the customer has all the needed tools to make sure they find out what is going on with their delivery. Ytb Industries (Pty) Ltd cannot take any responsibilities for the service that the courier company delivers, nor can Ytb Industries (Pty) Ltd be held accountable if any parcel is not delivered as per agree date with the courier company or when a parcel is accidentally misrouted, goes missing or goods are lost. The courier company is a 3rd party company, and they should be held accountable for all services delivered and not delivered after the parcel has left the premises of Ytb Industries (Pty) Ltd. Ytb Industries (Pty) Ltd will not be held accountable or responsible if any product arrives damaged or for any goods lost.

Insurance –
The customer is more than welcome to take out insurance of what the parcel is worth. Please take note that not all the courier companies that we make use of have the option for insurance and their coverage on parcels may differ, but we will mention all details regarding this to the customer before the customer choose the correct shipping method and courier company that suits their requirements. With this said, the customer takes full responsibility for the courier service and company they choose from our options provided. It is also the customer’s responsibility to ask for insurance on their parcel if needed. This insurance fee will be added to the invoice and will be paid to the courier company and therefore if something does happen to the parcel Ytb Industries (Pty) Ltd will then replace/refund the parcel to the value that the parcel was insured for. We cannot add insurance on a parcel that is already booked for shipment/delivery so the customer must mention insurance if needed in advance.

Insured parcel goes missing –
In the event where insurance is taken on a parcel and a parcel goes missing and the courier company is not successful in locating the parcel, the company will refund Ytb Industries (Pty) Ltd whereas we will either replace the goods that went missing or provide the customer with a refund which will be the same amount that the parcel was insured for.

Missed deadlines –
Ytb Industries (Pty) Ltd will send the parcel in time for the delivery date discussed between Ytb Industries (Pty) Ltd and the customer if possible, however we cannot control the actions brought forward by the courier company and Ytb Industries (Pty) Ltd can therefore not be held accountable or responsible for any such matter, therefor we do request the customer to place their orders in advance and make sure to have a deadline a week or two before their event or when the products are needed for. This allows for some time for couriers to sort out any issues on their end as well. Any missed deadlines caused by the courier company will not result in Ytb Industries (Pty) Ltd being responsible for this matter.

No insurance parcel goes missing/breakage –
In the case where a customer has not taken out insurance and the product does break or goods are lost during delivery, Ytb Industries (Pty) Ltd will not be held accountable to replace or refund the order and standard fees will apply. If Ytb Industries (Pty) Ltd was negligent in packing the order and proof can be provided Ytb Industries (Pty) Ltd will then replace the product that broke during delivery or refund the customer for the broken product, however, every product that leaves the premises of Ytb Industries (Pty) Ltd gets properly packaged and checked to minimise the chances of it breaking or being damaged during delivery/shipment.

Collection of and receiving package –
It is the customer’s sole responsibility to make sure that their package is collected/received from the courier service in the correct time frame. Should a package be returned, because the package was not collected/received in the correct time frame or for any other reason, the customer will be charged the full amount to resend their order/package and will be held accountable for any costs involved in this matter. It is the customer’s responsibility to arrange the resend of their order within 15 days on their own account otherwise the package and its contents will be the property of Ytb Industries (Pty) Ltd and will no longer be the property of the customer. The customer will not be refunded, and any subsequent order will be treated as a new order.

International shipping –
Ytb Industries (Pty) Ltd is registered to only trade in South Africa and therefore we regrettably do not ship internationally.

COLLECTION OF ORDERS:
If you are in the Cape Town area you are welcome to use our free collection/pick-up option. This option is also available for customers who prefer to make use of their own driver/courier for collection.

Customer’s own diver/courier for collection –
Please inform us should you want to make use of your own driver/courier for collection to arrange a day and time for collection and to ensure that we are available to hand over your parcel, once your order has left the premises of Ytb Industries (Pty) Ltd it no longer belongs to Ytb Industries (Pty) Ltd and therefore we cannot be held accountable or take any responsibility regarding the actions which the customer’s driver/courier company decides to take.

Arrange day and time for collection –
We will provide the customer with the full collection address, which will also be provided in your invoice. Please note that we will inform you via email/WhatsApp when your package is ready for collection. We will arrange a day and time for collection to make sure that we are available to hand over your package.

Payment on collections –
Ytb Industries (Pty) Ltd will only release orders once full payment is received and reflect in our bank account, and on completion of processing order. Ytb Industries (Pty) Ltd will only hand over packages on and during the arranged days and times made between Ytb Industries (Pty) Ltd and the customer.

BUSINESS OPERATING HOURS:
Ytb Industries (Pty) Ltd is a small business and therefore we have specific business hours to balance the answering of queries and production of products. Please note that business hours are subject to change without prior notice. It is not always possible to answer queries from our customers via email or our WhatsApp business account within a few minutes, especially during busy months or when we experience a high demand of messaging/queries, but with this said, Ytb Industries (Pty) Ltd will always respond to every customer’s query or message where applicable as soon as possible and to the best of our ability. The same goes for quotations and invoicing.

USING OUR SITE:
You agree that by accessing our site, www.ytbcompany.com, you have read, understood, and agree to be bound by all these terms and conditions. If you do not agree with all these terms and conditions, then you are expressly prohibited from using our site and you must discontinue use immediately. Supplemental terms and conditions or documents that may be posted on our site from time to time are incorporated herein by reference. We reserve the right, in our sole discretion, to make changes or modifications to these terms and conditions at any time and for any reason. Accordingly, customers who choose to access our site from other locations do so on their own initiative and are solely responsible for compliance with local laws, if and to the extent local laws are applicable.  Our site is intended for users who are at least 18 years old. Persons under the age of 18 are not permitted to use or register for our site and services. You agree to keep your password confidential and will be responsible for all use of your account and password.

SITE MANAGEMENT:
We reserve the right, but not the obligation, to:
(1) monitor the Site for violations of these terms and conditions.
(2) take appropriate legal action against anyone who, in our sole discretion, violates the law or these terms and conditions, including without limitation, reporting such user to law enforcement authorities.
(3) otherwise manage our site in a manner designed to protect our rights and property and to facilitate the proper functioning of our site.

Modifications and interruptions –
We reserve the right to change, modify, or remove the contents of our site or our WhatsApp business account at any time or for any reason at our sole discretion without notice. However, we have no obligation to update any information on our site or WhatsApp business account. We also reserve the right to modify or discontinue all or part of our site or WhatsApp business account without notice at any time. Ytb Industries (Pty) Ltd cannot guarantee that our site or WhatsApp business account will always be available. We may experience hardware, software, or other problems or need to perform maintenance related to our site or WhatsApp business account, resulting in interruptions, delays, or errors. We reserve the right to change, revise, update, suspend, discontinue, or otherwise modify our site and WhatsApp business account at any time or for any reason without notice to the customer.  The customer agrees that we have no liability whatsoever for any loss, damage, or inconvenience caused by your inability to access or use our site or WhatsApp business account during any downtime or discontinuance of our site and WhatsApp business account. Nothing in these terms and conditions will be construed to obligate us to maintain and support our site and WhatsApp business account or to supply any corrections, updates, or releases in connection therewith.

Corrections –
There may be information on our site, WhatsApp business account and quotes/invoices that contains typographical errors, inaccuracies, or omissions, including descriptions, pricing, availability, and various other information.  We reserve the right to correct any errors, inaccuracies, or omissions and to change or update the information at any time, without prior notice.

PRIVACY POLICY:
We care about data privacy and security. Please review our Privacy Policy posted on the Site. By using our site and services, you agree to be bound by our privacy policy, which is incorporated into these terms and conditions. Please be advised that our site is hosted in South Africa.  If you access our site from any other region of the world with laws or other requirements governing personal data collection, use, or disclosure that differ from applicable laws in South Africa, then through your continued use of our site, you are transferring your data to South Africa, and you expressly consent to have your data transferred to and processed in South Africa. Please read our privacy policy on our website.

ACCEPTANCE OF TERMS AND CONDITIONS:
By placing any order or remitting payment for any quote/invoice or any online order means that you as the customer has read and understand the above terms and conditions and by the means of proceeding with your order, Ytb Industries (Pty) Ltd will accept that the customer has no objections and understands all the terms and conditions mentioned in this document. Proceeding with any order will be consent as to agreeing to all terms and conditions and all supplementary documents mentioned in these terms and conditions and drafted by Ytb Industries (Pty) Ltd. It is the customer’s responsibility to check in with Ytb Industries (Pty) Ltd if any terms and conditions listed above is unclear. Ytb Industries (Pty) Ltd will not be held responsible for any terms and conditions not adhered to and Ytb Industries (Pty) Ltd is in no way forced to compensate any customer who has not read the terms and conditions or who goes against the terms and conditions. All above terms are final and none of the terms will be up for discussion and the customer has the free will to not proceed with an order if there is any disagreement regarding the terms and conditions of Ytb Industries (Pty) Ltd.
